Etérra may use artificial intelligence, machine learning systems, recommendation systems, large language models, and other automated technologies to provide and improve the Services.

Information submitted through the Services may be used to:

• Suggest wellness practices

• Improve product functionality

Where permitted by law, de-identified information may be used to train, improve, evaluate, validate, and develop artificial intelligence systems and models.  

AI-generated content is provided solely for educational and informational purposes.

MEDICAL DISCLAIMER

Etérra is not a healthcare provider.

The Services:

• Do not provide medical advice

• Do not diagnose disease

• Do not treat disease

• Do not establish a physician-patient relationship

Users should consult qualified healthcare professionals regarding medical decisions.

HIPAA DISCLAIMER

Etérra is not a healthcare provider, health plan, healthcare clearinghouse, or covered entity under HIPAA unless expressly stated otherwise.

Information submitted through the Services may not be subject to HIPAA protections.

Users should not assume that information submitted through the Services receives the same legal protections applicable to hospitals, physicians, or health insurance providers.

Payments are processed through third-party providers, including:

Etérra does not store complete payment card information on its servers.

GENETIC INFORMATION PRIVACY ACT (GIPA) — CALIFORNIA

Etérra is committed to protecting the privacy of genetic information in compliance with the California Genetic Information Privacy Act ("GIPA"), Cal. Health & Safety Code §§ 125100–125112, and any other applicable genetic privacy laws.

Scope of Genetic Data Collection 

Certain Services allow users to voluntarily submit or connect genetic testing results, microbiome testing results, biomarker data, and related health information. This data is collected solely for the purpose of personalizing educational content and wellness recommendations.

Consent Requirement

Before collecting any genetic information, Etérra will obtain your separate, explicit, informed, written consent. This consent will describe: (i) the specific types of genetic data collected; (ii) the purposes for which it will be used; (iii) whether and with whom it may be shared; and (iv) your right to withdraw consent at any time.

Prohibited Uses

Etérra will not:

  • Sell, lease, or otherwise transfer genetic data to any third party for any purpose without your separate explicit consent;
  • Use genetic data for advertising, marketing, or any purpose beyond those disclosed at the time of collection;
  • Share genetic data with any employer, insurer, law enforcement, or other third party except as required by law or with your express written consent.

 Withdrawal of Consent

You may withdraw your consent for collection or use of genetic data at any time by contacting us at support@healthiestchef.com with the subject line: "Withdraw Genetic Data Consent." Upon withdrawal, we will cease using your genetic data for the applicable purpose and will delete it unless retention is required by law.

LIMIT THE USE OF MY SENSITIVE PERSONAL INFORMATION

 California residents have the right to limit our use and disclosure of sensitive personal information to uses that are necessary to provide the Services and as otherwise permitted by the California Privacy Rights Act (CPRA).

We may update this Privacy Policy periodically.

Material changes may be communicated through website notices, email communications, or account notifications.

DISPUTE RESOLUTION AND BINDING ARBITRATION

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Informal Resolution

Before initiating formal dispute resolution, you agree to first contact us at support@healthiestchef.com and provide a written description of the dispute. We will attempt to resolve the dispute informally within 30 days.

Binding Arbitration

If we cannot resolve the dispute informally, you and Etérra agree to resolve any dispute, claim, or controversy arising out of or relating to this Privacy Policy or your use of the Services through binding individual arbitration, rather than in court, except as set forth below.

Arbitration Rules

Arbitration shall be administered by JAMS pursuant to its Streamlined Arbitration Rules and Procedures (or the Comprehensive Rules if the claim exceeds $250,000), which are available at www.jamsadr.com. The arbitration shall take place in Los Angeles, California, or by videoconference at either party’s election. The arbitrator shall apply Delaware law consistent with the Federal Arbitration Act.

Class Action Waiver

YOU AND ETÉRRA AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims.

Exceptions

This arbitration agreement does not apply to:

  • Claims that may be brought in small claims court;
  • Claims for injunctive or other equitable relief to prevent unauthorized use or misuse of the Services or intellectual property;
  • Any claim where applicable law prohibits arbitration.

If any portion of this arbitration agreement is found unenforceable, the remaining portions shall remain in full force and effect, except that if the class action waiver is found unenforceable, the entire arbitration agreement shall be null and void.

GOVERNING LAW AND JURISDICTION

This Privacy Policy and any disputes arising out of or related to it shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Arbitration shall be administered by JAMS pursuant to its applicable rules and shall take place in Los Angeles County, California, or by videoconference at either party’s election. The Federal Arbitration Act shall govern the interpretation and enforcement of the arbitration provision.

For any disputes not subject to arbitration, you and Etérra consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California.
